PRIVACY POLICY

1. General

1.1. We take data privacy seriously and are committed to protecting Your personal information

1.2. We will only use the personal information that we collect from You in accordance with this clause.

1.3. Personal information means information that can identify You as an individual. We collect information about You and Your use of the Software remotely and pursuant to Our subscription process. Personal Information does not include general, statistical, aggregated or anonymised information.

1.4. Your acceptance of this Licence as set out in the End-User Licence and Hardware Procurement Agreement, signifies Your consent to Us collecting and using Your personal information as specified below.

2. Security measures

2.1. We will take, implement and maintain all such technical and organisational security procedures and measures as may be necessary or appropriate to preserve the security and confidentiality of any personal information processed by Us, and will apply industry acceptable means to protect such information against unauthorised or unlawful disclosure, access or processing, accidental loss, destruction or damage.

3. How We collect information about You

3.1. You may provide personal information to Us:

3.1.1. when communicating with Us;

3.1.2. when ordering a product or a service and providing your name and e-mail address, so that the order can be processed and Your products (or services where appropriate) delivered to You. Sometimes, You may be asked for Your telephone number;

3.1.3. When You call Us, We may monitor or record Your calls and store details of the phone number(s) that You use to make the calls. This information is used to better address Your customer service needs; and

3.1.4. through the use of Google Analytics and cession cookies when You are using Our products or services.

4. How we use your information

4.1. We may use Your information to confirm that Your orders have been received; to validate You as a customer when using Our products or services or when You contact Us for support; to prevent and detect criminal activity, fraud and misuse or damage to Our services or networks; or to contact You to invite You to form part of Our consumer panel or various research groups.

4.2. We may also use Your personal information and process such information for the purposes of management, research, analysis, and improving business efficiencies. We may also on-sell de-identified information to third parties.

4.3. We may use personal information collected about You to contact you by electronic mail (that is email, picture, video, and SMS) about functionality changes to our Software, changes to the End-User Licence and Procurement of Hardware Agreement, or new services.

4.4. You hereby expressly consent that We may use your information for these purposes. Any such information collected about You will however only be used by Us for the specific purpose for which it was provided to Us.

5. Ownership

You acknowledge and agree that (a) the information collected by Us from You, and all right, title and interest thereto, is and shall remain Our exclusive property, and (b) except as expressly provided for otherwise, You shall have rights therein or thereto, including (without) limitation any entitlement to consideration for our Use or commercialisation thereof.

6. How long do we keep your information for?

6.1. The time periods for which We keep Your information may vary according to the use or purpose attached to the information. Unless there is a specific legal requirement requiring Us to keep your information, We will not keep it for longer than necessary for the purpose for which the information was collected or for which it is to be processed. We will in any event delete or destroy any personal information which has become obsolete.

7. Disclosing Your information to third parties

7.1. If You send Us an e-mail with a question or point of information that We consider to be of general interest, We reserve the right to quote the content of Your e-mail on Our website and/or our Discussion Group. In that case, We will remove any identifiable information. If You, however, wish something that You've written to be attributed to You, please let Us know.

7.2. We reserve the right to access and disclose Your personal information to comply with applicable laws, regulations and lawful government requests, to operate Our systems properly, or to protect Our company or Our users. We will also cooperate fully with any lawful investigation of possible payment fraud.

7.3. We may provide aggregate statistics about our sales, customers, traffic patterns and other website information to third parties, but these statistics will not include any information that could identify You.

7.4. We may from time to time elect to make use of agents to provide some of Our services (or part thereof), and Our services will then be offered through these agents. We may then share your personal information with them for the purposes set out in clause 4 above. The agents may also approach You directly and collect and process Your personal information, subject to obtaining Your prior consent. The agents may then share your personal information with us in turn for the purposes set out in clause 4 above.

8. Transfer of Your personal information to a third party who is in a foreign country

8.1. You hereby expressly consent that We may transfer Your personal information outside of the borders of the country where the data is collected from You.

8.2. We will ensure that a third party recipient in another country has securities measures in place which are no less stringent than those deployed by Ourselves.

9. How can You manage Your privacy preferences?

9.1. If You'd like Us to stop processing Your information or otherwise object to Us processing Your personal information, please email us at support@hexcode.co.za. We will then no longer process Your personal information.

9.2. Most browsers are set by default to accept cookies automatically, but usually You can alter the settings of Your browser to prevent automatic acceptance and to prompt You every time a cookie is sent to You or to allow You to choose not to receive cookies at all. 10. Can You gain access to the information We've collected about You

You have a right to access such information on request, and to rectify such information or cause this to be rectified by Us. Please contact Us at support@hexcode.co.za.

11. Complaints

If You are not satisfied with the way in which We process your personal information, You may lodge a complaint with Your information regulator.
